General

The customer declares to have acknowledged and accepted the present general terms of sale of the Jean-Denis Walter Gallery, deveoped by the Société J-D Walter, SASU with a capital of 10,000  euros, whose registered office is at 42bis, rue des Fratellini, 94170 Le Perreux-sur-Marne, France. Jean-Denis Walter Gallery shall hereafter be referred to as « The Gallery » for the sake of clarity.

 

Any order shall imply the automatic acceptance by the purchaser of the present general conditions. These conditions apply to the exclusion of all other conditions. They must be accepted in order to make the sale of photographic prints effective, or any other service offered by the Gallery.

These general conditions are available at all times on the website : www.jeandeniswalter.fr  and will prevail, where necessary, over any other version or contradictory document.

The Gallery reserves the right to modify the present general conditions without prior notice.

 

The Gallery

The Jean-Denis Walter Gallery markets art photographs in strictest compliance with French law which considers an Artwork to be : « photographs taken by the artist, printed by him or under his supervision, signed and numbered and limited to 30 copies, all sizes and mounts included » (article 98A of Annex III of the CGI, decreed 23.12.1991).

The photographs may be delivered framed, this extra service can be provided by the Gallery, but will be invoiced. The cost of framing will appear on the invoice in this case.

The author’s signtaure and details of the edition will be printed on a separate self-adhesive label that will be stuck on the back of the work. If the Artwork is sent by any means, the Gallery reserves the right to send the label separately.

 

Price :

The retail price of the photographs mentioned does not include framing or delivery costs.

Works of art are subject to changes in availability and prices without prior
notice.

 

Delivery

The Gallery has committed to using its best efforts to deliver ordered photographs as soon as possible, (between 10 and 20 days). Each order will be treated separately, the photographer will print the photograph as soon as he has been notified, and the delivery times are for indicative purposes only. A delay does not justify the order being cancelled, or any request for compensation.

The Gallery cannot be held responsible for any consequences as a result of late delivery.

In the case of payment by cheque, the order will be processed once the cheque has been cashed.

The packing, transport and insurance costs shall be borne by the seller.

 

Cancellation and returns

If the buyer is not satisfied with the Artwork, he has 7 days from receipt to return it to the seller. The buyer must return the Artwork to the Gallery in the condition in which it was received. Artwork that is returned incomplete, damaged or dirty will not be refunded.

The cost of framing the Artwork, if carried out by special request and made to measure, will not be refunded.

By sticking the self-adhesive label that contains details of the edition and the author’s signature on the print or the frame, the customer permanently waives the right to return the Artwork to the Gallery and in particular to exercise his right to a refund. If the customer wishes to exercise his right to a refund he must return the self-adhesive sticker unused, with the Artwork. If the buyer omits to return the self-adhesive sticker unused he will not receive a refund.

In case of a return and refund, the refund will be paid by cheque made payable to the person who ordered the art work, and sent to the billing address.

 

Intellectual property

All photographs for sale by the Jean-Denis Walter Gallery are protected by copyright. Buying an original print does not confer on the customer the right to produce any image or reproduction, to publish or submit for publication, or exhibit the Artwork to any third party for any purpose without written consent from the author.

 

All rights for explanatory texts, illustrations and photographs on Jean-Denis Walter Gallery’s website are reserved world wide under copyright and intellectual property.

 

Any full or partial reproduction of Jean-Denis Walter Gallery’s website is strictly prohibited.

 

Cancellation clause

The Jean-Denis Walter Gallery may cancel a customer order that has already been accepted if the latter cannot provide sufficient payment guarantees, and this without having to award damages to the customer.

Any print sold remains the property of the author and the Gallery until payment, interest and costs (framing and delivery) have been received in full.

 

Data Protection and Freedom of Information Law

Information concerning the customer allows the correct management of orders and customer files. In accordance with the law, customers have the right to access and correct data relating to them which can be exercised by contacting the Gallery.

The Gallery’s website is designed to best meet the expectations of its customers who are photography enthusiasts. In this capacity it regularly offers new photographs, as well as information about the photographers, or related events.

It is possible to stop receiving this information from the Gallery at any time by visiting the Gallery’s website.

 

Governing Law

 

These Terms and Conditions shall be governed by and construed in accordance with French law. Any dispute relating to the interpretation or implementation of these terms and conditions shall be submitted to the exclusive jurisdiction of the Paris Courts.
